Archivo fiscal y dificultades en demostrar la afectación psicológica de la agraviada

La investigación tuvo como objetivo analizar las disposiciones fiscales de archivo en casos de violencia contra la mujer, enfocándose en las dificultades para acreditar la afectación psicológica de la agraviada. El estudio se desarrolló bajo un enfoque cualitativo, con diseño de estudio de casos, utilizando el análisis documental de carpetas fiscales y entrevistas semiestructuradas a víctimas. Los resultados evidencian una limitada participación de las agraviadas en las evaluaciones psicológicas y una alta dependencia del sistema de justicia respecto a la prueba pericial como principal medio de acreditación del daño emocional. Asimismo, se identificaron factores sociales e institucionales, como la dependencia económica, el vínculo afectivo con el agresor y deficiencias en los servicios de atención, que inciden en la insuficiencia probatoria. Se concluye que el archivo fiscal responde a limitaciones estructurales del sistema probatorio más que a la inexistencia del delito.
The study aimed to analyze prosecutorial archiving decisions in cases of violence against women, focusing on the difficulties in proving the psychological harm suffered by victims. The research was conducted under a qualitative approach, using a case study design, with documentary analysis of prosecutorial case files and semi-structured interviews with victims. The results show limited participation of victims in psychological evaluations and a strong dependence of the justice system on expert evidence as the primary means of proving emotional harm. Additionally, social and institutional factors were identified, such as economic dependency, emotional ties with the aggressor, and deficiencies in support services, which contribute to evidentiary insufficiency. It is concluded that prosecutorial archiving responds more to structural limitations of the evidentiary system than to the non-existence of the crime.
