Introducción: La prescripción penal aplicada a delitos de terrorismo constituye un problema jurídico complejo debido a la tensión entre los límites temporales del ejercicio de la acción penal y la obligación estatal de investigar, juzgar y sancionar graves violaciones de derechos humanos. Objetivo: Analizar, desde una perspectiva dogmática y de derecho comparado, la insuficiencia del régimen de prescripción ordinaria y extraordinaria aplicado a los delitos de terrorismo en las modalidades de homicidio calificado y secuestro dentro del ordenamiento jurídico peruano. Metodología: Se desarrolló una investigación con diseño dogmático-analítico, sustentada en la hermenéutica constitucional, el análisis jurisprudencial y el estudio comparado de modelos jurídicos internacionales. Se examinaron normas nacionales, criterios jurisprudenciales y referencias del derecho comparado relacionadas con la prescripción y la persecución penal de delitos considerados de especial gravedad. Resultados: Los hallazgos evidenciaron que aproximadamente 1800 investigaciones fueron archivadas por prescripción, generando cuestionamientos sobre la respuesta jurídica frente a estos hechos. Asimismo, se identificó que la jurisprudencia nacional e interamericana reconoce criterios orientados a la imprescriptibilidad de determinadas graves violaciones de derechos humanos, mientras que diversos sistemas jurídicos comparados incorporan mecanismos similares. Conclusiones: El tratamiento jurídico de los delitos de terrorismo en las modalidades analizadas plantea la necesidad de revisar el régimen de prescripción penal peruano. Desde una perspectiva dogmática y constitucional, se plantea la discusión sobre la incorporación de la imprescriptibilidad y la adecuación normativa para garantizar la investigación y sanción efectiva de hechos de extrema gravedad.
Introduction: The application of criminal statutes of limitations to terrorism-related offenses constitutes a complex legal issue due to the tension between temporal limits on criminal prosecution and the State's obligation to investigate, prosecute, and punish serious human rights violations. Objective: To analyze, from a doctrinal and comparative law perspective, the insufficiency of the ordinary and extraordinary limitation regimes applied to terrorism-related offenses involving aggravated homicide and kidnapping within the Peruvian legal system. Methodology: A dogmatic-analytical legal study was conducted, based on constitutional hermeneutics, jurisprudential analysis, and comparative examination of international legal frameworks. National legislation, judicial criteria, and comparative law references concerning statutes of limitations and the criminal prosecution of particularly serious offenses were examined. Results: The findings showed that approximately 1,800 investigations were dismissed due to the expiration of limitation periods, raising questions regarding the legal response to these acts. Additionally, national and Inter-American jurisprudence recognize criteria supporting the imprescriptibility of certain serious human rights violations, while several comparative legal systems incorporate similar mechanisms. Conclusions: The legal treatment of terrorism-related offenses in the analyzed modalities highlights the need to review Peru's criminal limitation regime. From a doctrinal and constitutional perspective, the incorporation of imprescriptibility and regulatory adjustments is proposed as part of the ongoing debate to ensure the effective investigation and prosecution of acts of extreme gravity.
