Introduction: The exclusion of illegally obtained evidence constitutes an essential safeguard of due process and the adversarial criminal justice model. However, difficulties persist within the Peruvian criminal procedural system due to the limited regulation of Article VIII of the Preliminary Title of the New Code of Criminal Procedure (NCPP), resulting in divergent judicial criteria. Objective: To analyze the normative and systemic consequences of the regulatory omission concerning Article VIII of the Preliminary Title of the NCPP regarding the exclusion of illegally obtained evidence. Methodology: A qualitative doctrinal-legal study with a hermeneutic component was conducted. The analytical-synthetic, exegetical, and comparative methods were applied to a corpus comprising decisions of the Constitutional Court, Supreme Court cassation rulings, comparative legislation from Colombia and Chile, and specialized legal scholarship. Results: The findings revealed fragmented and contradictory judicial application of exceptions to the exclusionary rule, particularly concerning the independent source, inevitable discovery, and attenuation of the taint. These inconsistencies are associated with the absence of a specific procedure, clearly defined statutory grounds, and expressly regulated exceptions, thereby affecting uniformity and legal certainty in the assessment of evidence. Conclusions: Institutionalizing an autonomous evidentiary exclusion proceeding prior to the oral trial would strengthen the due-process-based adversarial criminal justice model. Accordingly, the study proposes incorporating Article 157-A into the NCPP to establish statutory grounds and exceptions, rules governing the burden of proof, and duly reasoned and appealable judicial decisions.
