Introduction: De facto unions in Peru present a legal issue concerning the determination of the applicable property regime, as Article 326 of the Civil Code establishes the community property regime as the default regime. This regulation raises questions regarding the autonomy of the parties to the union and the possibility of opting for a separate property regime. Objective: To analyze how the feasibility of choosing a property regime affects the regulation of de facto unions under Article 326 of the Peruvian Civil Code. Methodology: A qualitative study with a descriptive-explanatory design was conducted. Documentary analysis and bibliographic recording were used as the research technique and instrument, respectively, based on statutory, doctrinal, and legal sources, as well as criteria developed by the Registry Tribunal. Results: The findings showed that the legal system does not expressly prohibit cohabiting partners from replacing the community property regime with a separate property regime. Furthermore, party autonomy provides a legal basis for recognizing this possibility, in accordance with the criteria developed by the Registry Tribunal. However, the current regulatory framework presents a normative limitation because Article 326 of the Civil Code does not expressly provide for this possibility. Conclusions: The possibility for cohabiting partners to choose their property regime is legally viable and compatible with the principle of party autonomy. Consequently, a partial amendment to Article 326 of the Civil Code is considered necessary to expressly recognize this right and contribute to safeguarding the property and fundamental rights of persons in de facto unions.
