El uso adecuado y transparente de la expropiación y confiscación es vital para proteger derechos, garantizar justicia y fortalecer la confianza ciudadana y jurídica. El objetivo de la presente investigación fue describir el estado de las investigaciones sobre el uso arbitrario de bienes privados por el estado como forma de confiscación. La metodología utilizada fue una revisión sistemática cualitativa, se seleccionaron 15 artículos comprendidos entre 2020 y 2025, usando el método PRISMA. Los estudios concluyen que la expropiación y confiscación, aunque con fines distintos, requieren equilibrar objetivos estatales y derechos fundamentales. Para evitar abusos, deben basarse en procedimientos claros, participación ciudadana y control judicial efectivo, especialmente en urbanización, desarrollo económico y lucha contra el crimen. La falta de armonización normativa genera inseguridad jurídica y desconfianza. Es esencial una regulación clara, compensación justa y estándares probatorios estrictos. Persisten desafíos en su aplicación, destacando la necesidad de innovar mecanismos y fortalecer la capacitación para evitar prácticas arbitrarias.

The appropriate and transparent use of expropriation and confiscation is vital to protecting rights, ensuring justice, and strengthening citizen and legal trust. The objective of this research was to describe the state of research on the arbitrary use of private property by the state as a form of confiscation. The methodology used was a qualitative systematic review, selecting 15 articles from 2020 to 2025 using the PRISMA method. The studies conclude that expropriation and confiscation, although for different purposes, require a balance between state objectives and fundamental rights. To avoid abuse, they must be based on clear procedures, citizen participation, and effective judicial oversight, especially in urbanization, economic development, and the fight against crime. The lack of regulatory harmonization generates legal uncertainty and mistrust. Clear regulations, fair compensation, and strict evidentiary standards are essential. Challenges persist in their application, highlighting the need to innovate mechanisms and strengthen training to prevent arbitrary practices.
